Group bearing 20 per cent central members of party can form new one

The government has issued an ordinance according to which a group bearing 20 per cent of the central members of a political party can form a new party.

Words in sub-section (2) of the Political Parties Act, 2073 BS have been changed while sub-section (2a) has added to the Political Parties (Second Amendment) Ordinance, 2078 BS, introduced after certification by President Bidhya Devi Bhandari today on the recommendation of the government.

Instead of the term 'at least 40 percent of the members of the Central Committee and the parliamentary party in the federal parliament' in the Act, the ordinance states that '20 per cent or more members of the central committee elected by the general convention and of the central committee at the time of registration in case of a newly registered party or 20 per cent or more members of the party's federal parliament's parliamentary party'.

Similarly, Sub-section (2a) of the Ordinance states that if a new party is formed and if a member of the Provincial Assembly or a local level elected on behalf of the party immediately before the formation of such party joins the new party than it shall not be deemed to have left the party.

In the proviso phrase of sub-section 1 of section 48 of the Act, the words 'registered parties' are followed by the words 'or the new party formed under sub-section (2) of section 33'. Article 52 adds the proviso phrase reading, "but a member of a party recognized as a national party shall not be required to meet such percentage by proportional representation."

In Sub-section (1) of section 53 of the Act, a proviso has been added reading 'provided that the office bearers and members of the Central Committee of a party constituted pursuant to sub-section (2) of section 33 has to submit such details within 60 days of the registration of such party'.
