The writ filed against Prime Minister Pushpa Kamal Dahal in the Supreme Court has been heard by the single bench of Judge Bishwambhar Shrestha. The bench of the said writ is in the fourth order. Advocate Gyanendra Raj Aran and conflict victim Kalyan Budhathoki filed a writ filed last Tuesday and the preliminary hearing is going to be held today.
In a public program held in Tundikhel, Dahal had expressed that he would take responsibility for only 5,000 of the 17,000 people killed in the armed conflict. Based on the same expression, the writ petitioner has demanded that Dahal be arrested on criminal charges and investigated.
In the beginning, the court decided that an application based on political expression could not be registered. The joint bench of Justice Ishwar Khatiwada and Hari Phuyal ordered the registration of the writ on Friday.
According to the detailed peace agreement, they are demanding that the conflict-related incidents should be resolved by the Truth and Reconciliation Commission and not by the regular courts.
The power-sharing party, 8 parties of the Maoist line, and the Nepal Bar Association, an umbrella organization of lawyers, have also expressed their opposition to the writ filed against the PM.
