The constitutional bench that was formed to hear the writ petitions against the dissolution of the House of Representatives has again run into controversy today. Advocate Raja Ram Ghimire has filed an application stating that the 11 justices in the roster today including those who have been included in the constitutional bench cannot be include to hear the writs.
Ghimire filed a writ stating that justices who had been appointed through the parliamentary hearing and when Kalyan Shrestha and Sushila Karki were the chief justice and chairperson of the Judicial Council, respectively, cannot be included in the constitutional bench.
Meanwhile, Chief Justice Cholendra Shumsher JB Rana has urged Ghimire to withdraw the writ. He has warned that if the writ is not withdrawn then he will initiate a contempt of court case against the petitioner.
The constitutional bench today comprises of Chief Justice Rana and Justices Deepak Kumar Karki, Meera Khadka, Ishwor Prasad Khatiwada and Anand Mohan Bhattarai.
