The hearing on the writ petition filed against the dissolution of the House of Representatives (HoR) at the Supreme Court continued on the 10th day today.
Since many days have already passed by and there are still more petitioners yet to be represented, Chief Justice Cholendra Shumsher JB Rana, who is leading the Constitutional Bench where the case is being heard, urged the advocates to complete their arguments within 10 to 15 minutes. Five more writ petitioners are yet to present their arguments in favour of their respective petitions.
Earlier, CJ Rana noted that the people were getting bored of listening to the debate for a very long time.
Likewise, other members of the bench, Justices Anil Kumar Sinha and Sapana Malla also urged advocates to not repeat what has already been said and try to end their arguments sooner.
Around 250 legal practitioners representing both sides of the case have been registered to take part in the hearing.
So far, 47 advocates have presented their arguments on behalf of the writ petitioners.
Senior advocates Sher Bahadur KC, Harihar Dahal and Dr Yubaraj Sangraula took part in the hearing today. All three claimed that the Constitution does not provide any space for dissolution of the House, without taking confidence of vote of the HoR. The reasons behind a majority prime minister to dissolve the house are not clear.
The provision of dissolving the lower house was removed after the previous governments’ repeated act of dissolving the parliament, they said.
The hearing will continue tomorrow. Justice Tej Bahadur is the fourth justice in the constitutional bench who has been hearing the case since January 17.
