The full court meeting held at Supreme Court on Wednesday questioned which constitutional and legal provisions rendered void the impeachment motion against Chief Justice Cholendra Shamser Rana.
The meeting attended by all justices including Acting Chief Justice Harikrishna Karki raised the question: Which constitutional and legal provisions made ineffective the impeachment motion against Chief Justice Cholendra Shamser Rana at a time when the newly elected House of Representatives is yet to begin its work.
Following the meeting, joint registrar at SC, Narayan Prasad Regmi, shared the information that SC wrote a letter to the parliament secretariat questioning over legality of the letter it wrote on impeachment motion against suspended CJ Rana.
In relation to the impeachment motion registered at the House of Representatives (HoR) on February 13 early this year, the SC sought the status of the report submitted by the impeachment recommendation committee to the HoR. Is it extant or not?
Similarly, the full bench asked the parliament secretariat whether the report would be submitted to the HoR or not. If the impeachment motion was rendered ineffective, what the clear date was it got void- the date since then HoR expired, the date since the election was held, the date on which the CJ applied, the SC wanted to know from the parliament.
The parliament has been asked to furnish the response immediately.
On Wednesday morning, the SC had received a letter from parliament secretariat that the impeachment motion against CS Rana was rendered ineffective.
