Decision to revise Standards for crusher industry- Supreme Court

The government decision to revise standards for the operation of a crusher industry has been challenged in the court.

Advocates Padam Bahadur Shrestha, Raju Phuyal and Rakesh Kumar Shah have filed a writ petition at the Supreme Court seeking the withdrawal of the government decision. The document has named the Office of Prime Ministers and Council of Ministers, Ministry of Forests and Environment, the Department of Mines and Geology among others as defendants.

The revised provision excludes the phrase ‘river within 500 meters of the two-kilometer highway in the densely populated and forested areas’ from the Clause 4 (10) of Standards related to stone, gravel, sand excavation, sale and management, 2077 BS, the petitioners said in the writ, seeking the rescinding of the May 20 government’s decision through a certiorari.

The writ also demanded the cancellation of the decision of the Ministry of Federal Affairs and General Administration to propose for the amendment of the Standards.

The court has assigned the hearing on the writ on June 22.
