Justices KC and Shrestha refuse to vacate constitutional bench

Justices Tej Bahadur KC and Bam Kumar Shrestha have refused to vacate the constitutional bench that has been formed to hear the writ petitions filed at the Supreme Court against the dissolution of the House of Representatives.

As per an agreement made earlier, it was decided that the constitutional bench from now on would comprise of justices based on seniority. The agreement was reached during talks between the Supreme Court Bar Association and Chief Justice Cholendra Shumsher JB Rana.

Chief Justice Rana had agreed to the formation of a constitutional bench based on seniority within a week.

It has also been agreed upon to amend the guidelines related to the formation of the constitutional bench. The Judicial Council will amend the necessary guidelines within a week after which cases related to constitutional disputes will be heard by a constitutional bench formed of justices based on seniority.
