A writ petition has been filed at the Supreme Court on Thursday arguing that the federal government's 'prosperous Tarai-Madhes irrigation special programme,' had breached the jurisdiction of Province-2.
Minister for Physical Infrastructure and Development at Province-2, Jitendra Prasad Sonal filed the writ petition mentioning that the Ministry of Energy, Hydropower and Irrigation at federal government forwarded contract for the special programme, which, Sonal argued, actually falls under the jurisdiction of Province-2 government.
The Department of Water Resources and Irrigation had issued tender notice on November 9 which was against the Constitution, the writ argues, asserting that the federal government was reclaiming authority devolved to the provinces.
The petitioner also stressed that the notice on tender was against constitutional provision, spirit of federalism and infringing upon the jurisdiction of provincial government. With this logic, he has demanded an interim order to stop the move.
Hearing on the petition is scheduled to take place the constitutional bench of the apex court on December 11.
