A hearing on the petition filed against the creation of the Koshi Province administration is now taking place before the Supreme Court (SC).
The hearing for the writ, which contests the manner in which the administration led by Chief Minister Uddhav Thapa was formed, is being presided over by the full bench of the SC.
Hikmat Kumar Karki, a former chief minister of Koshi Province, filed the suit with the Supreme Court after objecting to Uddhav Thapa's nomination as chief minister, which contained Speaker Baburam Gautam's signature.
The bench comprising Justices Sushma Lata Mathema and Til Prasad Shrestha issued a judgment on Monday referring the matter to the full bench for adjudication due to the difficulty of the legal issues at stake.
This choice is consistent with Rule 23(c) of the Supreme Court's rules, which permits referral to a joint bench when a complicated legal matter necessitates the knowledge of a complete bench.
