The Supreme Court (SC) on Monday ordered not to implement the decision to relieve Lumbini's four provincial assembly members from their post.
A single bench of Justice Nahakul Subedi issued the order not to implement the decision stating that the decision of Lumbini Province Assembly Secretariat to relieve four lawmakers of Janata Samajbadi Party-Nepal citing that the move is against the constitution and laws.
With the order of the SC, the four lawmakers’ post has been reinstated.
It is said that the lawmakers were not given opportunity to furnish their clarifications before their removal from the parliamentary party member, which was against the principle of natural justice.
Prior to this, the then Province Assembly member Santosh Kumar Pandey, Bijay Bahadur Yadav, Suman Sharma Rayamajhi and Kalpana Pandey had filed writ petitions at the SC on Sunday challenging the party’s decision to remove them from the post.
They had been removed from the post for allegedly going against the party to support Chief Minister of Lumbini, Shankar Pokharel, who had a no-confidence proposal registered at the provincial assembly.
