Short-term interim order against local election's Code of conduct

The Supreme Court has issued a short-term interim order against the code of conduct for local elections.

A single bench of Justice Bamkumar Shrestha on Tuesday issued a short-term interim order not to implement the provisions of the code of conduct. Also, Judge Shrestha has ordered to call for discussion on the interim order.

Nima Galgen Sherpa, chairperson of Helambu village municipality of Sindhupalchowk, had filed a writ petition against the code of conduct on Monday.

The code of conduct prepared by the Election Commission had provided that the incumbent people's representative at the local level had to resign before becoming a candidate again.

In the writ petition, an interim order has been sought to remove the provision as the local level will become vacant if the people's representative resigns before the election. The Election Commission has been made the opposition in the writ filed by Sherpa. The Supreme Court has ordered both the parties to appear for discussion on the issue on March 27.
